Winter Grand Jury Meets
Arraignment Day Nov 16
Some days
in Court are more exciting than others. Skirmishes, a Judge
yelling at an attorney, screw ups with paperwork... if you're
looking for that in this article, ain't going to happen,
didn't happen. Judge Ric Facemire presided over the courtroom
duties.

Johnny Dale Rogers II
Felony
25 goes to repeat offender Johnny Dale Rogers.
Dressed in orange, the 35 year old has been charged with
murder, use or presentment of a firearm, destruction of
property, arson 3rd degree. For his time in Court Rogers was
clean shaven including his head and talked straight with Not
Guilty Sir. Attorney Kevin Hughart will handle his courtroom
duties up in Braxton County on Feb 28th beginning at 9am. His
bond remains at $100K.
Attorney Herb Hively will
handle Felony 26 for Henry Stutler who stands ready
for trial on malicious assault With his shaved, tattoos on the
back of his head and his butt crack hanging out, the 30 year
old was of course not guilty when asked. His trail was set for
Jan 10th at 9am.

Jerri Lynn Harlow
The name Jerri
Harlow (Felony 27) has been through the court system on
more than one other occasion. Dressed in orange and dark
haired, Ms Harlow continues her trend with burglary, grand
larceny, destruction of property, prohibited person with a
firearm. Herb Hively was also assigned this case. The 34 year
old is set for trial Jan 4th at 9am. Her surety bond
remains at $30K .

While not
present for this arraignment day, Felony 28 goes to that lad
with charges including fleeing with reckless indifference to
the safety of others, fleeing from a Badge by any means other
than a vehicle and no insurance. Betty Gregory is the
defense attorney for Hotchkiss

Adam Deare
The thing
about getting caught with drugs, any Judge always asks, where
did you get em, who did you buy em from?
Enter Adam Deare with Felony 29, already a
felony and charged with having a firearm, Judge Facemire began
the questioning with where did you get the meth? Deare
hesitated to answer any follow up questions.
Defenser Andy Chattin knew his client was peeing off the
robe and took him out of the room to have a come to Jesus
session. Upon reentering the courtroom, Deare was much more
cooperative with Facemire and provided a name. Sorry we
couldn't hear the name. Deare: he had traded for the meth and
smoke it all.
Trail date for the civilian clothes clad lad is Jan
10th at 9am. He remains free on a $10K bond.
Some kind of screw up with Felony 30,
Tracy Johnson who is charged with entering without breaking,
petit larceny, and conspiracy x 2. Attorney Herb Hively
told the Court, you've got the wrong one here. Judge Facemire
agreed that Lakin Center transported the wrong person that
morning. Sorry no pic available that we could find.
Austin Levy Johnson, 23 year of age, Felony 31, has
been hanging around for two terms of Court awaiting a speedy
trial. Dressed in civilian clothes and brown headed, he
too is set for a Jan 10th at 9am trial. The Court set a $15K
bond for Johnson.
Any male was talked about but we didn't catch his
name. He's located in some kind of facility and will have a
status conference on Jan10th if we heard correctly.
All those in civilian clothes were whiz tested before
getting turned lose.
How are they going to have more than one trial on Jan
10th? Most of the bad folks end up pleading their case. Our
guess, upwards of 95% of the cases are plead down and never go
to Court. The offenders know if they can get a few years off
their sentence, it's easier on em. Cheaper too. Wait wait
irate readers.... Even if it's just a few years in the slammer
instead of many many behind bars, they're still off the
streets for a long while and just maybe, may reform their ways
will sitting in jail. Maybe!
Up there at the top comes the indictment Johnny Dale
Rogers. Remember that arrest. Not in a good way but once
again Clayberry made regional news outlets. Here's a sampling
of what they world heard.
From TV 5: "CLAY COUNTY, W.Va. (WSAZ) - A man accused
of killing his mother is now behind bars.
According to a criminal complaint from Clay County Magistrate
Court, Johnny Dale Rogers, 34, of Widen, W.Va., confessed to
shooting his mother in the head, pushing her car over an
embankment, and setting it on fire. The investigating
officer said on Wednesday, April 20, he was dispatched to
Widen Ridge Road for a vehicle fire. The officer said a
body was found inside the vehicle and was told the driver of
the vehicle was believed to be Darlene Faye Jackson. The
officer said he discovered Jackson’s son, Johnny Dale Rogers
II, lived with his mother on the 600 block of Kanawha Street
in Widen. According to the criminal complaint, the
officer went to Jackson’s home where he was met by Rogers.
Rogers said his mother dropped him off on Widen Ridge Road to
go turkey hunting and that Jackson then drove to Fire Tower
Road to drop off food to a woman. Rogers told
investigators he began to worry about his mother when he had
to walk back to his home on Kanawha Street. According to
officers, Rogers told them that’s when he drove his ATV to
Widen Ridge Road and discovered his mother’s vehicle over the
embankment. Rogers said he called his sister and told
her about the vehicle. His sister then contacted Clay
County 911. State Police questioned the woman Rogers
claimed his mother was delivering food to and she told them
she hadn’t spoken to Jackson in several months. Rogers
was being questioned by state police at the Clay Detachment,
when he confessed to shooting his mother in the head with a
.22 Magnum rifle, pushed her vehicle over the embankment on
Widen Ridge Road and set it on fire with her inside.
Rogers is currently in the Central Regional Jail."
Remember Darlene Faye Jackson? We knew her as Darlene
Rogers from Widen. At times Darlene was controversial with her
community activists positions. She was also the lady that went
around helping those in need. Back 20 years ago it was
Darlene that led the charge to use a local wawa source so the
entire town could have potable wawa. That didn't happen
and a large portion of Widen remains without affordable,
potable wet stuff
Darlene will be missed.
