GW Not Guilty But Still in Jail




  If you ask 10 people, do you know Grayling Workman, the majority would say, Who? Around Clayberry we know the guy as GW. For years, GW has been the handy man for many repairing /building, sheds, walls, roofing, and about anything else you want done.
  GW spent a lot of time in the news and more time in jail during 2020. Although the guy has never been known as an angel, earlier transgressions have been minor for the most part. That changed in July 2020 when he came to his girlfriend's house and low and behold, another man was inside with his long time sweety. Things went South real quick with GW administering a solid dose of kick arss to the lad banging around in GW's private stash.
  With charges filled, Workman started spending his nights on your dime in Central Regional Jail (CRJ) nearly 8 months ago.
  GW got his day in Court March 31st. Barrister Herb Hively represented GW. Up front on the bench was Judge Jack Alsop. Prosecutor Jim Samples  represented the State.
  Here's the other major players in this court case.
  GW's squeeze, Cathy Davis. Cathy worked with GW for several years doing those odd jobs and handyman chores. Side by side they worked day in and day out. GW often lived with Cathy and had a key to her residence.
  The guy that got caught in the wrong place at the wrong time, that would be Houston Bullard from Maysel. After years working at Bullard's Exxon on Route 4, Houston is well known in County Clay.
  On March 31st, no social distancing was practiced in the Courtroom. Perspective jurors were seated side by side. Those 12 selected for jury duty, they did their work seated shoulder to shoulder. Masked were required apparel for everyone inside the room.
  GW was seated by attorney Herb Hively and never flinched, showed emotion, or fiddled around. Badges threw the book at Workman to see which would stick, Charges included: Breaking and entering, domestic battery, destruction of property, malicious wounding, strangulation along with other things. We didn't hear any mention of GW drop kicking Houston's gonads more than once but we think that happened. Maybe there's not a law for kicking of the private area.
  Prosecutor Samples got things underway with  GW entered the house... he caused harm to Cathy... he injured Houston... caused damage to a Subaru windshield... GW started the fight.. find him guilty....
   Herb Hively is an experienced defense lawyer and has handled some tough cases. It was Mr Hively who tried his best to represent Hiram Lewis several years back. That was a real challenge for the attorney and worth a huge Atta Boy.
   Hively explained things a little differently from Samples. In a nutshell:  GW had been living with Cathy who had also been seeing Houston.... GW went to work July 30th, when he got home on the 30th, it was dark...GW found Houston's car parked nearby.... Needless to say, GW got mad big time.... He went to the door but Cathy turned him away...
   The peed off big time GW went back to work but returned around 1am with a full head of steam ... GW used his door key to gain entrance... inside, he could see, Uh Oh, Houston in the bedroom... Houston started fighting the 57 year old Workman.... Cathy tried to stop the fight.... The punching continued...  Progressing outside, Houston picked up a 2 x 4 with nails in it and started swinging away.....
   Houston reported the broken windshield to Green Shirts later that day.
  Houston had a gun.
   GW told him, If you shot me, I will kill you!!!
   Grayling Workman lived there.
   Houston threw the first punch.
   Green Shirt Wiseman told the jury: at 1:45am on the 31st, Bullard had a red neck, black eye, scratches on both Houston and Cathy who jumped on GW's back; and no handgun was found.
   Hively questioned the Green Shirt and came up with: they did not search to see if GW's belongings were inside the house...he did not see any scratches to GW's hands... Houston received no EMS  treatment...Cathy did not mention a gun  even after 911 Dispatch asked about the presence of a gun...
  Then there was a head scratcher over pictures taken that night. Reference had been made about the photo evidence but it took the Judge to ask, Where's the pictures??
  Turns out Samples had  a dozen pictures or so but didn't seem to want them introduced. Hmmmmm..
   Often Clayonians give Jim Samples double H for lackluster performance before, during and after court cases. He deserves some of the criticism for sure. But this time, in this case, Samples' star witnesses and victims, Houston and Cathy, were rotten on the stand.
  Here goes readers. Houston was first up front.
  Under questioning, Houston  did not see GW break the windshield out of his Subaru... Cathy invited Houston over that night... Houston did not see GW kick in the front door but did see GW and Cathy fighting in the floor and he tried to stop them...
  Get this readers, Houston Bullard could not even remember what they were fighting about. He did admit to having the 22 mag pistol in his pocket. He did draw the pistol because he thought GW was going to hurt Cathy.
  Here's another cluster, Houston Bullard never mentioned having a pistol to the Badge during the investigation!!!!
  Samples worked hard to get Houston to say anything substantial but without much luck. Remember, it was Mr Bullard and Cathy Davis  that were the victims!
  Under cross, Samples couldn't even get Bullard to admit to a romantic relationship with Cathy Davis. As for remembering much of anything, he didn't except that he felt GW kicked him in the head three times with work boots on.
   When Hively started asking Houston questions, he did get Houston to admit to having a romantic relationship but just not that night. He had pointed the gun at GW. GW did tell Houston, I'll take that gun and whoop your ass with it. Houston then put the pistol back in his pocket. And And and, Houston  Bullard told the Court, he never saw GW punch Ms Davis.
   You could see the frustration level increase 10 fold on Samples' face.
   It's about to get worse for Samples
  Cathy Davis got on the stand. When she sat down, she winked at GW. Samples saw the wink and was furious!!!!!!!! Question after question with denials from Cathy. Nooooo, heck no, I didn't went at GW.
   Davis was refusing to answer questions. Any answers she did provide were in whispers so the jury couldn't really hear what as going on. She was not cooperating with the Prosecution.
  At one point, the star witness tried to plead the 5th amendment . Judge Alsop made it clear, she could not do that. Over and over Samples to Cathy, "I can't hear you mam!"
   As Samples showed her transcripts of what she provided law enforcement, she turned away and wouldn't even read her own statements.
   The best our Prosecutor could get out of her was: I didn't feel pain on my forehead... He was crazy that night! ...  she was afraid that night and and  the grand enchilada, star witness Cathy Davis disputed her own statement and didn't remember seeing GW hit Houston with the 2 x 4. She couldn't remember seeing GW trying to strangle Houston with the board across the neck.
  It went on and on with the Prosecutor losing ground with each question to Ms Davis.
  Both witnesses had bailed out the state's case. Both perjured themselves with each answer.
  Herb Hively asked the Court to toss the entire case. Judge Alsop didn't.
     Samples closed the case with little direct testimony. Hively told the jury, this was a case of self defense since Houston had a pistol and beat GW with it. No one saw GW break out Houston's windshield.
   It took 4 1/2 hours to prove, Houston (the victim supposedly) was burying the salami in someone else's bun and Houston pulled a gun and boards with nails in it on Mr Workman.
  It took the Jury over an hour to agree, Grayling Workman was not guilty of anything.
  To us in the peanut gallery, self defense sounds right. Also, the question has to come, how many on that jury had gotten caught with their pants and skidaddled out a back door before an irate husband clobbered them?
  Think GW walked out a free man? Wrong.
  Sometime last fall, after Cathy called him to come over one Fall evening, Badges picked him up for breaking terms of his bond agreement and put him the slammer. True all the charges are gone but that outstanding violation is still alive over in Magistrate Court land.
  So, after 8 months on your dime ($48.25 each night) and after being found NOT guilty of everything, Grayling Workman remains behind bars.
  So much for getting your new shed built this Spring!
